16px;">对此，吴玥气愤异常。吴玥辩称，自己与李畅相恋多年，本已谈婚论嫁，但因林琳的介入导致分手。婚后，出于对自己情感的亏欠，李畅主动提出金钱补偿，并在其婚后半年内，分笔转账给吴玥200万元。这笔“分手费”是李畅自愿赠与，并非自己主动索取。李畅无法在婚后半年就创造出200万元的夫妻共同财产，因此200万元“分手费”源自李畅婚前个人积蓄。李畅将婚前个人财产赠与自己作为“分手费”，没有侵害林琳的权利，故拒绝返还该款项。</span></section><section 16px;">除了“分手费”之外，自己和李畅之间还有其他经济往来。此前，李畅为公司出面向吴玥借款，念及旧情，吴玥出借给公司330万元，并与公司订立了《借款协议》，约定的还款时间为2022年。林琳到吴玥公司大闹后，吴玥要求李畅尽快还款并了断一切关系。此后李畅在吴玥的催促之下陆续转账还款，合计金额为350万元，与《借款协议》约定的本息金额相当。</span></section><section 16px;">法院经审理后认为，李畅婚后半年内，未经妻子林琳同意，数次向前任女友吴玥支付“分手费”的行为，有违公序良俗，且支付的款项明显不属于夫妻日常生活开支，应认定为对夫妻共同财产的擅自处分，存在过错，损害了林琳对夫妻共同财产享有的权益，应属全部无效。在李畅同意全部款项均返还给林琳的前提下，吴玥应向林琳返还该200万元。</span></section><section 16px;">对于其余350万元，因吴玥明确否认该款项的性质为赠与，且在李畅转账之前，吴玥与李畅担任法定代表人的公司之间有其他资金往来，李畅也曾为公司代收款项，而吴玥亦明确表示不会对公司另行主张权利，法院无法认定李畅对吴玥的350万元转账是赠与行为，故而难以支持林琳要求吴玥返还350万元的诉求。最终，法院判决由吴玥返还林琳200万元。</span></section><section
